The applicable legal entity, governing law, and jurisdiction are determined automatically at checkout based on billing location and payment routing configuration.

2. Software Description & Scope

EXM Tweaks is a system and performance optimization software intended to improve operating system, network, and hardware configuration efficiency.

The software:

  • does not modify or distribute game files

  • does not inject code into games or applications

  • does not bypass, interfere with, or disable anti-cheat systems

  • operates only through user-enabled settings and voluntary features (e.g. Game Mode)

All optimizations are applied locally on the user’s system and can be reverted.

3. No Performance Guarantees

The software is provided “as is” and “as available.”

EXM Tweaks makes no guarantees regarding:

  • specific FPS gains or latency reductions

  • uninterrupted operation

  • compatibility with all hardware, drivers, operating system updates, or third-party software

Results vary depending on individual system configuration, hardware quality, operating system state, and network conditions.

4. User Responsibility

The user is solely responsible for:

  • compliance with third-party terms of service (including game publishers and platforms)

  • compliance with all applicable local, national, and international laws

  • any actions taken using the software and any resulting consequences

EXM Tweaks is not responsible for penalties, bans, restrictions, or enforcement actions imposed by third-party services.

5. Payments, Subscriptions & Refund-First Policy

Billing & Subscriptions

Payments are processed via Stripe using region-appropriate payment methods.
Subscriptions may be canceled by the user at any time through the billing portal.

6. Limitation of Liability

To the maximum extent permitted by law, EXM Tweaks shall not be liable for any:

  • indirect

  • incidental

  • consequential

  • special

  • punitive damages

Total liability shall not exceed the amount paid by the user for the software during the preceding 30 days.

7. Arbitration & Class Action Waiver (US Only)

This section applies only to users contracting with EXM Tweaks Inc., Delaware, USA.

Any dispute arising out of or relating to these Terms shall be resolved through binding arbitration under the laws of the State of Delaware.

Users waive any right to participate in class actions, collective actions, or representative proceedings.

This section does not apply to users contracting with EXM Tweaks s.r.o., Slovakia.

8. Minors

We acknowledge that a portion of our users may be minors.

  • Use of the software requires consent from a parent or legal guardian

  • The parent or guardian assumes full responsibility for payments and compliance

  • Refund requests for unauthorized minor usage are handled promptly under the refund-first policy

9. Changes & Contact

These Terms may be updated at any time. Continued use of the website or software constitutes acceptance of the updated Terms.
